Terms of Use of Services

INTRODUCTION

These Terms of Service ("TOS") are an electronic record under the Information Technology Act, 2000 and its rules. Since this is a digital document, it does not require a physical or digital signature.

The Peppy mobile application ("App") is owned, operated, and maintained by Peppy Friends ("We", "Us", "Our"). Any capitalized terms not defined here will have the meaning given in the Intermediary Guidelines 2021 or, where relevant, in the Digital Personal Data Protection Act, 2023.

LEGALLY BINDING TERMS

These Terms are a legally binding agreement between you ("User/You/Your") and Peppy Friends. They apply to your use of the App and all related features or services (collectively, the "Services").

Peppy provides a platform where users can create profiles, connect with others, and engage in live interactions and entertainment-based content ("Content"). By accessing or using the App in any way, you agree to follow these Terms.

If these Terms or our Privacy Policy are not acceptable to you, please do not register, access, or use the App. We may update these Terms from time to time. Your continued use of the App means you accept the updated Terms.

OUR SERVICES

Peppy is a social entertainment platform where users can interact with others (including "Streamers") through live audio, video, or digital sessions.

Who are Streamers?

Streamers are a category of users who showcase their personality, skills, or interactive abilities through paid or pro-bono sessions for counselling, mentorship, career guidance, entertainment, or social engagement. Peppy collects payments on their behalf and pays them after deducting service fees.

What you can do on Peppy

• Creating and managing your user profile
• Viewing other user or Streamer profiles
• Engaging in live social interactions with Streamers
• Sending and receiving audio/video messages or comments
• Following, connecting, and interacting with known or anonymous users
• Posting content with or without using your real name (including pseudonyms)
• Using optional paid features depending on availability

What Peppy does not provide

• Any nudity or unlawful content-Peppy follows a strict No Nudity Policy. Any such session may be terminated immediately without refund.
• Background verification of Streamers or Users
• Offline meetings/communication-any attempt to interact offline can lead to permanent removal and loss of wallet balance
• Sharing of personal contact details
• Matchmaking or formal introductions
• Employment or contractual relationships with Streamers-Streamers are independent and we do not verify them
• Guaranteed availability of Streamers-they choose when to interact

Interactions with unknown or anonymous individuals can have unpredictable outcomes. Please be cautious and prioritize your safety. If you are under 18, you are not allowed to use Peppy.

AGE AND RELATED RESTRICTIONS

Peppy is strictly for individuals who are 18 years or older. By registering or using the App, you confirm that:

• You are legally an adult (18+)
• You have not been suspended or banned from Peppy or any of our Services in the past
• You have the authority and capacity to agree to these Terms
• You have not been convicted of any criminal offence
• Your local laws do not restrict you from using services like Peppy

When creating your account, you must provide accurate and up-to-date information. Peppy may verify your age using internal checks, ask for additional information, or use third-party verification services. If we are unable to confirm that you are 18 or older, Peppy Friends may decline to create your account, suspend or permanently close your existing account, and forfeit any unused wallet balance, offers, or credits associated with the account.

ACCOUNTS & IDENTIFICATION

We offer a free account, but you must register to access all features of our Services. When creating your account, you may choose any username/handle/display name.

• Your registration information must be accurate and complete
• Your username/handle/display name must not contain abusive, misleading, or inappropriate language or imagery
• Buying or selling accounts, usernames, handles, or display names is strictly prohibited
• If you choose to use a pseudonym, we may still need to share information with law enforcement if required by law

We may ask you to verify your identity or complete checks if needed under the law or for security reasons. You are responsible for keeping your account secure and must not share your password with anyone. Any actions carried out using your account will be treated as authorized by you. If you believe someone has gained access to your account, contact our Grievance Officer right away.

CONTENT-RELATED RESTRICTIONS

All content shared on the Peppy App must follow the Intermediary Guidelines 2021 issued by the Government of India. As a User, you must not upload, post, share, or store any content on the App that:

• Is harmful to children or minors in any way, including any form of sexually explicit or abusive content (zero tolerance for CSAM)
• Contains sexually explicit, pornographic, erotic, abusive, violent, or grossly harmful material
• Intentionally misleads others about the source of a message or knowingly spreads false/misleading information
• Threatens India's unity, integrity, security, sovereignty, foreign relations, public order, or encourages crime/interferes with investigations
• Promotes unlawful online games or prohibited advertisements
• Violates privacy, promotes hatred, racism, discrimination, defamation, money laundering, gambling, or unlawful activity
• Infringes rights including copyright, trademark, privacy, publicity, or other IP rights
• Harasses, threatens, bullies, promotes violence (including self-harm/suicide), or depicts gratuitous violence
• Is against any applicable laws

Peppy is an intermediary platform-we allow users to create and interact with content, but we do not control or endorse everything that gets uploaded. All content on the App is the responsibility of the person who created or shared it. If you see anything harmful or inappropriate, please use the App's reporting tools or contact our Grievance Officer.

USER LICENSE

You own the content you create and post on Peppy. We do not claim ownership of it. However, you are fully responsible for anything you post.

By posting or submitting content on Peppy, you give Peppy Friends a non-exclusive, royalty-free, transferable, worldwide license to host, use, distribute, modify, run, copy, reproduce, and process your content across all formats and media. You confirm that you have the rights/permissions required to post your content and that your content does not violate any rights of others.

PROHIBITIONS ON ACCESS

To keep Peppy safe for everyone, you must follow this TOS and all applicable laws. You may NOT:

• Use the Services if you are a minor or not legally competent
• Reverse engineer, decompile, translate, or attempt to extract source code or algorithms
• Sell, rent, lease, transfer, or commercially exploit any part of the App or its data
• Use the App for unauthorized commercial solicitation or advertising
• Use bots/crawlers/scrapers/automation to access or extract data
• Impersonate someone else or misrepresent your identity
• Upload malware/viruses, spam, chain letters, pyramid schemes, or private information of others
• Encourage dangerous or illegal activities or post hateful, racist, discriminatory, or violent content

PAYMENTS

Some features on Peppy may require you to pay a fee. If you choose any paid plan or feature, you must provide valid payment details and confirm you are authorized to use the payment method.

All payments made for subscriptions or paid features are non-refundable, under any circumstances. We may update pricing from time to time and will notify you through reasonable methods.

WARRANTIES AND REPRESENTATIONS BY YOU

By using the Peppy App, you confirm and agree that:

• You are authorized to access and use the App as per these Terms and the laws applicable to you.
• If you are using the App on behalf of an organization, you have authority to do so and both you and the organization are responsible for actions taken through the App.
• You understand that you use the App and Services at your own risk and that interactions with known or unknown people can have unintended consequences.
• You are free to stop using our Services at any time.

COMPLIANCE WITH APPLICABLE LAW

Peppy is operated from India. We do not guarantee that the App or its content is suitable for use outside India. If you access the App from another country, you do so at your own risk and are responsible for complying with local laws.

PRIVACY POLICY

Please read our Privacy Policy to understand how Peppy Friends collects, uses, stores, and shares your personal information.

DISCLAIMERS, LIABILITY & INDEMNITY

Disclaimer of warranties

The App and all content are provided "AS IS" and "AS AVAILABLE", and we make no guarantees of any kind-whether express, implied, or statutory-about accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, or non-infringement.

We do not conduct background verification of any user (including Streamers). Any interaction or engagement with any user is at your own risk.

Indemnification

You agree to protect, defend, and compensate the Company and its affiliates for any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from your use of the Services or your violation of this TOS or any law.

Limitation of liability

To the fullest extent permitted by law, the Company will not be liable for any indirect, special, incidental, punitive, or consequential damages, loss of profits/data/goodwill, or damages beyond reasonable control.

MODIFICATION, SUSPENSION & TERMINATION

Peppy Friends may, at its sole discretion and without liability to you, modify, temporarily pause, or permanently stop any part of the Services at any time. We may also suspend or terminate your account with or without prior notice.

We may remove content you post if it violates this TOS, our policies, or if the law requires us to do so. If you believe your content was removed by mistake, you can contact our Grievance Officer using the official grievance process.

Termination by user

You may request to delete your Peppy account at any time by sending us a written request. Once we receive your request, we may follow a reasonable notice period before permanently deleting your account, as required by applicable law and our retention obligations.

Effect of termination

If your access to the Services ends or if Peppy is discontinued, we may deactivate your account and related data. We will retain and use certain information only as required to comply with legal duties, resolve disputes, and enforce our agreements.

PROPRIETARY RIGHTS

Everything you see, use, or access on the App-including the technology, design, features, and all other materials ("Company Materials")-is owned by the Company, our partners, or third-party licensors and is protected by applicable laws. You may use Company Materials only while you have permission to use the Services and only in the way we allow. The Company name, logos, product names, and all other marks appearing on the App are trademarks owned by us or our licensors.

THIRD-PARTY CONTENT

The App may contain links or connections to third-party websites or services (for example, payment gateways or verification services). Clicking these links does not mean we operate, control, or endorse those sites.

• When you leave our App, you may be subject to the terms and privacy policies of the third party.
• You are responsible for reviewing third-party policies before sharing information or making transactions.
• The Company is not responsible for the content, actions, or services of third-party sites.

BREACH OF TERMS

If you violate any part of this TOS-or if we reasonably believe you have-we may take one or more of the following actions (without affecting other rights we may have):

• Send warnings (where appropriate)
• Temporarily suspend your access or account
• Permanently block you from using the App and Services
• Take legal action for breach or other violations
• Forfeit any balance/coins/digital currency in your wallet without refund where permitted by law

GOVERNING LAW

This TOS will be governed by the laws of India. Any disputes related to this TOS will fall under the exclusive jurisdiction of the Courts of Rajasthan.

OTHER TERMS

Non-waiver

If we delay or choose not to exercise any right under this TOS, it does not mean we are giving up that right.

Severability

If any part of this TOS is found invalid or unenforceable, the rest of the TOS will remain fully valid and enforceable.

Force majeure

We are not responsible for any delay or failure in providing the Services caused by events beyond our control, including natural disasters, extreme weather, war, riots, strikes, government actions, or power/communication failures.

Assignment

You may not transfer your rights or obligations under this TOS without our prior written permission. However, we may transfer or assign our rights or obligations (fully or partially) without notice, as permitted by law.

Entire agreement

This TOS is the complete and final agreement between you and the Company regarding the use of our App and Services.
